- Brownfields- We work with Buyers of Property and Developers to redevelop contaminated industrial properties and assist them in obtaining grants, loans, sales tax rebates, and seeking contribution from responsible parties.
- Dry Cleaners- We have represented dry cleaners with regard to matters involving the NJDEP as well as with regard to obtaining insurance coverage for perc related cleanup issues.
- Environmental Litigation- We have experience in litigation against responsible parties for pollution to your property including gasoline stations, dry cleaners, heating oil tank owners, dumpers of hazardous waste and other contributors to pollution found at a site.
- ISRA- This law is triggered primarily by the sale of an industrial establishment such as a manufacturing facility or the sale of its property. We take you through the entire process from notice to the NJDEP to the receipt of a No Further Action Letter. We work with consultants which are fair and reasonable with regard to the cost of any remediation that may be required.
- Underground Storage Tanks- If a tank shows evidence of a spill or a discharge during its operation or removal, the soils and often groundwater must be investigated and remediated. We will get you the right consultant to handle any cleanup and assist you in demanding insurance coverage from your carrier.
- NJDEP Enforcement- If you receive notice of a fine regarding any NJDEP program alleged violation, we will assist you in defending against the imposition of any penalty and will negotiate the terms including payment required. The NJDEP will negotiate downward the cost of a penalty in most instances. If necessary we can demand a hearing to contest any charges of violations.
- Real Estate Transactions- We have represented both buyers and sellers as well as landlords and tenants with regard to negotiating protective language in Contracts of Sale and Leases to assure our clients are not responsible for environmental conditions which predated their ownership and/or use of a site, along with appropriate indemnifications.
- Permits- We can assist you in obtaining NPDES permits for water discharges, air permits for emissions under the State’s Clean Air Act, RCRA permits for hazardous waste generators, etc.
