Gas Stations
On several occasions we have been able to negotiate with major oil companies to clean up properties which were operated and/or owned by our clients. In one case, the client had purchased the gasoline tanks from the franchisor/oil company, yet we were still able to force them to take responsibility for the entire remediation of the property without the need to file any litigation.
Former Gasoline Stations
Enlisting the process of negotiation, we have been able to help some clients obtain substantial cash settlements with major oil companies with regard to properties that had been used previously for gasoline stations. In some such situations, there was no need to initiate litigation. On other occasions, litigation has been required in order to maximize recovery on the client’s behalf.
Former Operators Which Have Contaminated Properties
As in the case of gasoline stations, we have represented many companies which “inherited” pollution problems caused prior to their ownership or operations at a site. Typically, we have had success in either requiring the former owner/operator to take responsibility and conduct the remediation at the property without the need for bringing a lawsuit. In situations which are more costly and complicated by several responsible parties, litigation may be required in order to bring about the most favorable outcome for our client.
