The Chemical Factory

We were referred a client in the Iron Bound section of Newark from an environmental consultant with which I have worked for many years as an environmental insurance recovery lawyer.  The client had been at the same site for most of the last century in the chemical business and had substantial environmental remediation costs relating to ground water and soil contamination from its operations.  The client had no idea of the potential to use old insurance policies to pay for cleanup costs, and had no idea about who its insurers in the past had been. We spent a day going through the company’s old files and found a copy of  a fire department document which contained the number for an old insurance policy. Based upon that number, I was able to settle an insurance claim on the client’s behalf for close to three quarter of a million dollars.


The Residential Heating Oil Tank

A resident of Hoboken was about to sell an apartment building when he discovered that the heating oil tank for the building had been leaking for some time. I was given insurance information and a letter from the carrier stating that there was no coverage for this claim. After reviewing the consultant’s report and the insurance policy, I wrote a several page letter to the carrier explaining why their denial letter was not in keeping with relevant New Jersey insurance cases and the client was promptly granted full coverage for a cleanup that cost nearly $300,000. This same scenario has been played out at several other residential properties.


The Tool & Die Shop

A tool and die shop in Union County which had been operating there since the Second World War had a severe chlorinated solvent problem primarily as a result of its operations over the decades.  Before the property could be sold, contamination to ground water and soils had to be remediated. Once again, the client had no idea that insurance policies from years back could solve his cost problem. Once again, after a series of letters back and forth to the carrier, an initial denial of coverage was revised to provide 100% coverage of an over $300,000 cleanup. The property is now used as a mozzarella cheese factory.
